For prescription drug advertisements for human use presented directly to consumers in television or radio format, the major statement of major side effects and contraindications must be presented in a clear, conspicuous and neutral manner, and in television format it must be presented concurrently using both audio and text.

消費者に直接向けてテレビ又はラジオの形式で提示される処方箋医薬品の広告では、主要な副作用及び禁忌に関する major statement を明瞭・顕著かつ中立的な方法で提示しなければならず、テレビ形式では音声と文字を同時に用いる(dual modality)ことが必要である。

この規定は 88 FR 80983(2023年11月21日)の最終規則で追加され、2024年5月20日施行。取得した2024年版CFRでは本文ではなく § 202.1 への施行日注記として掲載されており、その注記本文を逐語で確認した。基準は (A) 消費者にわかりやすい平易な用語、(B) 音量・発音・速度が広告の他の部分の音声と同等以上に理解可能、(C) テレビでは音声の逐語のキーワード又は全文を同時表示し表示時間は音声と同時に開始・ほぼ同時に終了、(D) 文字の大きさ・書体・背景とのコントラスト・画面上の配置が読みやすいこと、(E) major statement の提示中に理解を妨げるおそれのある音声・視覚要素を含めないこと。米国で消費者向け広告が一般に許容されるか否かについては、この規定が消費者向けテレビ・ラジオ広告の存在を前提としていること以外、別途の確認はしていない。
