Member States must prohibit advertising to the general public of medicinal products that are available on medical prescription only or that contain substances defined as psychotropic or narcotic by international convention, while medicinal products that by virtue of their composition and purpose are intended and designed for use without the intervention of a medical practitioner may be advertised to the general public.

加盟国は、処方箋によってのみ入手可能な医薬品及び国際条約により向精神薬又は麻薬と定義される物質を含む医薬品について、一般向けの広告を禁止しなければならず、その組成及び目的からみて医師の関与なしに使用されることを意図・設計された医薬品は一般向けに広告することができる。

Article 88(1), (2)。あわせて Article 88(3) は加盟国が償還対象医薬品の一般向け広告を自国領域で禁止することを認め、(4) は当局が承認した業界によるワクチン接種キャンペーンを (1) の禁止の対象外とし、(6) は販促目的で業界が一般公衆に医薬品を直接配布することの禁止を加盟国に求める。EU本文の入手経路と国内実施法に関する留保は efficacy の note と同じ。
