Directive 2001/83/EC defines advertising of medicinal products in Article 86(1) as any form of door-to-door information, canvassing activity or inducement designed to promote the prescription, supply, sale or consumption of medicinal products, without limitation as to medium, and Articles 86 to 100 contain no provision specific to digital or social media.

指令2001/83/ECは第86条(1)において医薬品の広告を、医薬品の処方・供給・販売又は消費の促進を目的とするあらゆる形態の戸別訪問による情報提供、勧誘活動又は誘引と、媒体を限定せずに定義しており、第86条から第100条にデジタル又はソーシャルメディアに固有の規定は置かれていない。

これは指令本文についてのみの記述であり、Article 86 から Article 100 までを通読して確認した。デジタル媒体での販促がEUで規制されないという意味ではなく、媒体を限定しない定義と各国の国内実施法及び自主規制規約がこれを担う。Title VIIIa の Article 88a はインターネットを含む情報提供の実態について委員会が報告書を提出すべきことを定めるのみで、広告主に対する規則を課していない。EFPIA規約は、公開PDFのリンクが404を返し、EFPIAのページにも版番号・発効日の記載がなかったため、現行版を特定できず引用していない。EU本文の入手経路と国内実施法に関する留保は efficacy の note と同じ。
