Claims of efficacy
All parts of the advertising of a medicinal product must comply with the particulars listed in the summary of product characteristics, and the advertising shall encourage the rational use of the medicinal product by presenting it objectively and without exaggerating its properties and shall not be misleading (Directive 2001/83/EC, Article 87(2) and (3)). The Directive binds Member States as to the result, and what a reviewer applies is the national implementing law. One national implementation has now been read: the German Heilmittelwerbegesetz (HWG). Section 3 HWG makes misleading advertising unlawful and treats as misleading in particular (1) attributing to a medicine a therapeutic efficacy or effects that it does not have, (2) falsely creating the impression that success can be expected with certainty, that no harmful effects occur on intended or prolonged use, or that the advertising is not carried out for competitive purposes, and (3) making untrue or deceptive statements about the composition or properties of the medicine or about the person, training, qualifications or achievements of the manufacturer or inventor. Section 3a HWG prohibits advertising for a medicine that is subject to authorisation and is not authorised, and likewise where the advertising relates to indications or pharmaceutical forms not covered by the authorisation. Section 4(1) HWG requires every advertisement for a medicine to carry the name and registered office of the pharmaceutical company, the name of the medicine, its composition, indications, contraindications, adverse effects, warnings, and for prescription-only medicines the statement 'Verschreibungspflichtig'; section 4(2) requires those particulars to agree with those prescribed for the package leaflet.
医薬品の広告のすべての部分は製品概要(summary of product characteristics)に記載された事項に適合しなければならず、広告は当該医薬品を客観的にその特性を誇張することなく提示して合理的使用を促すものでなければならず、誤導的であってはならない(指令2001/83/EC 第87条第2項・第3項)。指令は結果について加盟国を拘束するものであり、審査担当者が適用するのは国内実施法である。国内実施法の一例としてドイツの Heilmittelwerbegesetz(HWG、薬事広告法)を確認した。HWG第3条は誤導的広告を違法とし、とくに(1)医薬品等に有しない治療上の有効性又は作用を帰属させる場合、(2)成功が確実に期待できる、用法どおり又は長期に使用しても有害作用が生じない、当該広告が競争目的で行われていない、との印象を誤って生じさせる場合、(3)組成・性状、又は製造者等の人物・学歴・能力・実績について虚偽又は欺瞞的な記載をする場合を誤導とする。第3a条は承認義務のある医薬品で未承認のものの広告、及び承認の範囲外の適応・剤形に係る広告を違法とする。第4条第1項は、すべての医薬品広告に製薬企業の名称・所在地、医薬品の名称、組成、適応、禁忌、副作用、警告表示、処方箋医薬品の場合は「Verschreibungspflichtig」の表示を含めることを義務づけ、第4条第2項はこれらの記載が添付文書について定められた記載と一致しなければならないと定める。
2026-09-23 に国内実施法を初めて確認した。ドイツの HWG 全文を gesetze-im-internet.de の統合版 https://www.gesetze-im-internet.de/heilmwerbg/BJNR006049965.html から取得し、第3条・第3a条・第4条をドイツ語原文で読んだ。同ページの脚注は HWG が EGRL 55/97(31997L0055)及び EWGRL 28/92(31992L0028、2001/83/EC 第8編の前身である医薬品広告指令)を実施するものであることを示している。取得した版は「zuletzt geändert durch Art. 5 des Gesetzes vom 26. Juni 2026」と記載されており、その改正は「textlich nachgewiesen, dokumentarisch noch nicht abschliessend bearbeitet」との注記がある。確認したのはドイツ1か国のみであり、他の加盟国の実施法は確認していない。ある加盟国の規律を他の加盟国に及ぼして読んではならない。EUR-Lex の人間向けページは AWS WAF のJavaScriptチャレンジで到達できないままだが、EUの CELLAR に対する content negotiation (curl -H "Accept: application/xhtml+xml" http://publications.europa.eu/resource/celex/32006L0114 )は成功し、2006/114/EC の本文を取得できた。2001/83/EC 本文は前回同様 EMA 掲載の統合版PDFから読んでおり、最新の統合版と一致するかは確認していない。
